JOBMATES is a recruitment platform with primarily two types of users - job seekers and recruiters. The website is www.jobmates.com.
This User Agreement constitutes a binding agreement between the User (“RECRUITER and the JOB SEEKER”) and JOBMATES or the Company operating the Website for the Country in which You live or in which business is headquartered (“JOBMATES”), and are deemed accepted by You each time You use or access any JOBMATES Site or Services. If You do not accept the Terms stated here, we request you to not use the JOBMATES Website and Services. However, this Agreement is subject to change without prior intimation and the service buyer is bound by all the terms and conditions mentioned on JOBMATES website. JOBMATES reserves the right to update the Agreement uploaded on the Website and also to update the version on the webpage. The Users are urged to read the Terms and Conditions carefully before the use of the platform/website www.jobmates.com. The Users are advised to visit this page periodically to review the most current Terms because they are binding on You.
The JOBMATES Platform/ Website are owned and operated by HIREBASE RECRUITMENT PLATFORM Pvt. Ltd. (referred to herein as "we," "us," "our," or "JOBMATES”), which has developed Platform/Website/Services for use of a Job Seeker who is looking for a Job in the Market and an Employer/ Recruiter who is looking for the right candidate for their Entity.
JOBMATES SERVICES: The JOBMATES Services are defined as the applications and services offered by JOBMATES, including an on-line service to post and search employment opportunities and/or any mobile or other interface that allows You to access such application (collectively, “JOBMATES Services”).
USERS/SUBSCRIBER: User refers to any person who uses/freely accesses the website and joins the website as Job seeker and Recruiter as well as avails the JOBMATES services.
POST: The term “post” as used herein shall mean information that You submit, publish or display on a JOBMATES Site.
SCOPE OF SERVICES
JOBMATES is a cloud based platform that connects job seekers with recruiters worldwide wherein job seekers looking for opportunity can put their applications in the common pool for various different roles such as full-time, part-time, contractual employment, internships etc. pertaining to all the job fields. The platform also allows the recruiters to post their vacancies on the platform against which the job seekers can post their applications. It also allow the recruiters to access the full database/common pool of all job applications that the job seekers have put in the platform and they can contact the desired candidate through the email id and contact information provided by the job seekers in the platform.
Users of JOBMATES sites hereby represent and warrant that he/she are at least 18 years of age or the age of legal majority in the User’s jurisdiction, whichever is higher. If the User is under the age of 18, User may not use or access the Platform. If JOBMATES discovers or has any reason to suspect that User is not at least 18 years of age, JOBMATES reserves the right to suspend or terminate access to the Services immediately and without notice.
The users shall be able to post their job listing posts on the website and receive applications regarding the same on the platform.
The users can filter, sort and manage the applications based on the tools provided.
The user can look into the common talent pool for applications which are suitable for their job posting and also reach out to those candidates by sending a message to the said candidate or showing interest by sending an interest request.
The user can use the premium subscription plan to see the complete job applications along with the job seeker’s contact information (if they have chosen to share).
By using the promotion plans, the users can boost their job postings, by advertising them to the job seekers and the job seekers can promote their profiles by advertising to the right recruiters.
JOBMATES also intends to provide general resources that we feel will help the users, in terms of blog posts, information documents, articles, videos and other related material.

Understand that when you post a job opportunity on JOBMATES website or trigger an email to a Job Seeker, a snapshot of your public profile on JOBMATES Recruiter may automatically get inserted into the posting/mail (existing or new job listing on JOBMATES Website).
Understand that JOBMATES may place the information relating to vacancies posted by you through Your Account in any of classified sections on the JOBMATES Website as JOBMATES may deem fit and proper.
To make your resume searchable to all recruiters and your contact information visible to all paying clients of JOBMATES who subscribe to JOBMATES database. You may be contacted by subscribers of JOBMATES via email, telephone and/or post. If you wish to modify this setting and make yourself non-searchable, you may reset this in the Edit Profile section. We recommend that you read the privacy settings carefully and JOBMATES will not be held responsible for contacts/mails received by you.
Receive job alerts (mails detailing jobs that match your profile as entered on www.jobmates.com) via email. You may remove yourself from the job alert email database by resetting this option in the My Account section of your resume.
Receive promotional mails/ special offers. You may remove yourself from the promotional mailer email database by unsubscribing to them in the email itself.
INTELLECTUAL PROPERTY RIGHTS:
All trademarks copyright, trademark, patent, and/or other proprietary rights and laws and service marks of the product are owned by JOBMATES/ HIREBASE RECRUITMENT PLATFORM PVT. LTD and are the property of their respective owners. The trade names, trademarks and service marks owned by the Company, whether registered or unregistered, may not be used in connection with any product or service that doesn’t belong to the Company, in any manner that is likely to cause confusion. Nothing contained on the Platform/ Website/ Mobile Application should be construed as granting, by implication, estoppels or otherwise, any license or right to use Company’s trade names, trademarks or service marks without the express prior written consent of the Company.
All the Job Seekers as well as the Recruiters (Users) of the JOBMATES services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the website.
CLAIMS AND COMPENSATIONS:
The user shall have the right to submit claims in situations determined by the current legal regulations, especially in the case of any incorrectness in the operation of the JOBMATES Platform/ Website or in compliance of the services with these Terms & conditions.
Claims may be submitted by e-mail to JOBMATES e-mail address mentioned in the Contact us tab below. A claim should at least include the User’s first and last name, the e-mail address under which the User utilizes the Platform/ Website, a detailed description of the problem, and the postal address of the User (if the claim is submitted by email). If the information provided by the User is insufficient or requires complementary/more detailed data, JOBMATES shall ask the User filing the claim for such data, and the moment of filing the claim shall be the date when JOBMATES obtains more detailed data for investigating the claim. JOBMATES shall investigate the claim within Fifteen (15) days from obtaining it, and the User shall be forthwith informed about its result.
DISCLOSURE BY THE RECRUITERS
The subscriber/Recruiter shall give an undertaking to JOBMATES that the jobs sought to be advertised on JOBMATES.com are in existence, genuine and that the subscriber has the authority to advertise the jobs.
The subscriber/Recruiter must give an undertaking to JOBMATES that there will be no fee charged from any person who responds to jobs advertised on the classified section of JOBMATES sites for processing of such person.
The recruiter shall give an Undertaking that they will not re-sale nor transfer the Subscription to any other person, corporate body, firm or individual. Usage from third party premises/networks without prior written permission of JOBMATES is strictly prohibited.
The Recruiters profile may be updated/edited etc. by the user/recruiter only. The user shall not upload, post, transmit, publish, or distribute any material or information that is unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libellous, vulgar, obscene, or racially, ethnically, or otherwise objectionable.
DISCLOSURE BY THE JOB SEEKERS
The subscriber/Job Seeker shall give an undertaking to JOBMATES that the details/documents provided by You for seeking job through JOBMATES websites are true to their knowledge and are genuine and that the same shall be advertised on the JOBMATES sites.
The Subscriber/Job Seeker shall provide up to a maximum of 2 email ids for advertising the same along with the details, and which can be used by the Recruiters to contact them in person.
The Job Seeker shall give an Undertaking that they will not transfer the Subscription to any other Job Seeker or individual. Usage from third party premises/networks without prior written permission of JOBMATES is strictly prohibited.
The Job Seekers profile may be updated/edited etc. by the user/Job Seeker only. The user shall not upload, post, transmit, publish, or distribute any material or information that is unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libellous, vulgar, obscene, or racially, ethnically, or otherwise objectionable.
JOBMATES neither guarantee nor warranties that there would be a satisfactory response or any response at all once the resume / insertion or information/data is fed by the user.
JOBMATES neither guarantees nor offers any warranty about the credentials bona-fides, status or otherwise of the prospective employer/organization which downloads the resume/ insertion or information/data and uses it to contact the user.
JOBMATES would not be held liable for loss of any data technical or otherwise, or of the resume/insertion or information/data or particulars supplied by users due to acts of god as well as reasons beyond its control like corruption of data or delay or failure to perform as a result of any cause(s) or conditions that are beyond JOBMATES’s reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, distributed denial of service attacks, virus attacks, war and natural calamities.
Comply with legal process, including, but not limited to, civil and criminal proceedings, court orders or other compulsory disclosure;
Enforce this Agreement;
Respond to claims of violation of rights of third parties, whether or not the third party is a member, individual, or government agency;
Respond to customer service enquiries; or
Protect the rights, property, or personal safety of JOBMATES, our members or the public.
The Services include a variety of products and services that are free to use (“Free Services”), as well as certain products and services that require payment (“Paid Services”). We reserve the right to charge for Free Services or change the price for Paid Services, at any time. If you purchase any of our Paid Services, you agree to pay us any applicable fees and taxes. You also agree to any additional terms that we may notify you apply to the applicable Paid Services. You hereby authorize the collection of such amounts either directly by JOBMATESor indirectly via a third-party payment processor. Failure to pay these fees will result in the termination of the applicable Paid Service. If you are directed to a third-party payment processor, you may be subject to terms and conditions governing the use of that third-party’s service and that third-party’s personal information collection practices.
Please note that JOBMATESis not liable for any bank fees, foreign exchange fees, or differences in prices based on location. JOBMATESor its third-party payment processor may store and continue billing your payment method (e.g., credit card), to charge you for other Paid Services you may buy.
SUBSCRIPTION PLANS FOR THE JOB SEEKERS
JOBMATES offers the promotion plan to the Job Seekers to advertise their job Application in the common talent pool or otherwise in order to promote themselves. The subscription packages can be renewed after expiration.
JOBMATES agrees to provide the services to the subscriber/Job Seeker only for the duration contracted for to the best of its ability. If the subscriber/Job Seeker wants to continue using the services with JOBMATES, they have to renew the subscription with the same plan or any other plan whatsoever. Payment for the same shall be made duly upon renewal, after which JOBMATES will commence providing services only upon receipt of amount/charges upfront either from the subscriber plans mentioned above or from a third party on behalf of the subscriber/Job Seeker.
Only one individual or Job Seeker will be entitled to use the service using one plan or account linked to it. Third Party using the account of any other individual is prohibited.
The subscriber/Job Seeker shall bear the sole responsibility of the safe custody of the password and JOBMATES shall not be responsible for data loss/theft of data or corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. JOBMATES undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber.
The subscriber/Job Seeker to JOBMATES services shall be entitled to such number of listings during the period of subscription as may be agreed upon.
JOBMATES reserves its right to reject any insertion or information/data provided by the subscriber/Job Seeker without assigning any reason, but in such an eventuality, any amount so paid for, may be refunded to the subscriber on a pro-rata basis at the sole discretion of JOBMATES.
Recruiters (Employers) shall be solely responsible for their postings on JOBMATES sites. JOBMATES is not to be considered to be an employer with respect to Your use of any JOBMATES Site. JOBMATES shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on any JOBMATES Sites. The Recruiter shall not be allowed to download or modify the information collected from the JOBMATES platform. In case of any discrepancy/error or fraud with respect to the information obtained from the JOBMATES platform, Recruiter shall not hold JOBMATES responsible for the same.
By accepting to use the services provided by JOBMATES, You hereby accept to own all the risks involved, including but not limited to the risk of physical harm, of dealing with strangers, underage persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom You come in contact through the JOBMATES Sites. By its very nature other people’s information may be offensive, harmful or inaccurate, and in some cases will be mislabelled or deceptively labelled. We expect that You will use caution and common sense when using the JOBMATES Sites.
Job Seekers shall be solely responsible for their postings on JOBMATES sites. JOBMATES is not to be considered as an employer with respect to Your use of any JOBMATES site. JOBMATES shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on any JOBMATES sites.
By accepting to use the services provided by JOBMATES, You hereby accept to own all the risks involved, including but not limited to the risk of physical harm, of dealing with strangers, underage persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom You come in contact through the JOBMATES Sites. By its very nature other people’s information may be offensive, harmful or inaccurate, and in some cases will be mislabelled or deceptively labelled. We expect that You will use caution and common sense when using the JOBMATES sites.
It shall be sole prerogative and responsibility of the Job Seeker to check the authenticity of all or any response received pursuant to the resume posted or information/data being fed into the network system of JOBMATES by the Job Seeker, for going out of station or in station for any job or interview. JOBMATES assumes no responsibility in respect thereof and expressly disclaims any liability for any act, deed or thing which the user may so do, pursuant to the receipt of the response, if any, to the resume/insertion or information/date being fed into the network system of JOBMATES.
Uploading of multiple resumes beyond a reasonable limit by the same individual, using the same or different accounts shall entitle JOBMATES to remove the Resumes without notice to the subscriber. This service is only meant for candidates looking for suitable jobs. Any usage with commercial intent is prohibited.
The user represents that he/she is not a minor and is not under any legal or other disability which limits his/her ability to comply with these Terms or to install and use the services subscribed and purchased with minimal risk of harm to you or others. You further represent that you are not purchasing the products/services for resale to others and will not do so without JOBMATES’s prior written consent.
The resume posted or information/data fed by the Job Seeker can be updated by the Job Seeker alone, free of cost. However, this free service entitles the Job Seeker alone i.e. the same person, to add modify or change the data/information fed in by him but does not entitle him to use the free service to feed fresh insertion or information/data /resume of another person in place of the insertion or information/data already fed in by such user.
The subscriber/Job Seeker shall bear the sole responsibility of the safe custody of the password and JOBMATES shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. JOBMATES undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber.
Even though you may have marked your profile as unsearchable, on viewing a JOBMATES job posting when you are logged into your JOBMATES.com account, a snapshot of your profile maybe made visible to the recruiter.
All changes/modifications made by the Job Seeker to the data/information will come into operation only after 24-48 hours of such changes/modifications being made.
JOBMATES RIGHTS AND OBLIGATIONS
JOBMATES will commence providing services only upon receipt of amount/charges upfront either from the Jobseeker/Recruiter or from a third party on behalf of the subscriber.
JOBMATES shall in no way be held liable for any information received by the subscriber and it shall be the sole responsibility of the subscriber to check, authenticate and verify the information/response received at its own cost and expense.
All information intimated by the Job Seeker/Recruiter and displayed by JOBMATES on the JOBMATES sites becomes public knowledge and JOBMATES may at its sole discretion include the job applications/Job listings for display on JOBMATES sites in any other media including the print media and JOBMATES cannot be held liable for usage/publicity of such information.
JOBMATES is not responsible for the information posted on the JOBMATES sites. JOBMATES offers no guarantee or warranties that there would be a satisfactory response or any response at all once the job is put on display.
JOBMATES would not be held liable for loss of any data whether of technical nature or otherwise or all or any, information or particulars supplied by the customers due to the reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond JOBMATES’s reasonable control including but not limited to strike, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities.
JOBMATES reserves its right to change the look, feel, design, and prominence, and depiction, classification of the job search/ candidate application search section of JOBMATES sites at any time without assigning any reason and without giving any notice.
JOBMATES reserves its right to reject and delete any resume/ insertion or information/data fed in by the user without assigning any reason.
Although JOBMATES will make all possible efforts to adhere to the privacy settings, it will not be responsible for a resume being seen by a blocked user for any reason. For best privacy settings it is recommended that you do not allow your resume to be searched at all by deactivating your applications.
You agree to indemnify, defend and hold harmless JOBMATES, its affiliates and each of their respective principals, shareholders, agents, officers, directors, consultants, and employees from or against third-party claims, damages, payments, deficiencies, fines, judgments, settlements, liabilities, losses, costs, and expenses arising from or relating to any third-party claim, suit, action or proceeding arising out of or related to your use or purchase of the Services, your violation of the rights of any third-party or person, or your breach of these Terms or any representation or warranty contained herein. The JOBMATES reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify JOBMATES, and you agree to cooperate with JOBMATES’s defense of these claims. JOBMATES will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
The User shall indemnify JOBMATES against any responsibility resulting from claims of third parties relating to infringement of their personal rights by the User utilizing JOBMATES Platform/ Website. Any data theft or leak of personal information or to infringement of intellectual property rights connected with the content and software which is not made available by JOBMATES Platform/ Website.
JURISDICTION AND DISPUTE RESOLUTION:
Any dispute, controversy or claims arising out of or relating to this Agreement or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the provisions of the [Indian] Arbitration and Conciliation Act, 1996.The Arbitral Tribunal shall be composed of one Arbitrator appointed by JOBMATES/HIREBASE RECRUITMENT PLATFORM PVT. LTD. The place of Arbitration shall be at Ahmedabad, Gujarat. The Arbitral procedure shall be conducted in English language and the award or awards shall be rendered in English. The procedural law of the Arbitration shall be Indian Law. The award of the Arbitral Tribunal shall be final, conclusive and binding upon the Parties, and the provisions of the Arbitration and Conciliation Act, 1996 shall apply. The rights and obligations of the Parties under, or pursuant to, this Clause, including the Arbitration Agreement in this Clause, shall be governed by and be subject to Indian law, and the Agreement shall be subject to the exclusive jurisdiction of the courts at Ahmedabad, Gujarat.

INFORMATION PROVIDED BY JOBMATES SITES MAY BE RELIED ON BY ITS USERS AT THEIR OWN DISCRETION. WE PROVIDE THE PLATFORM FOR RECRUITERS AND JOB SEEKERS AND ALL INFORMATION AND SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS. JOBMATES DOES NOT CONTROL OR VET USER GENERATED CONTENT FOR ACCURACY. WE DO NOT PROVIDE ANY EXPRESS WARRANTIES OR REPRESENTATIONS. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, JOBMATES DISCLAIM ANY AND ALL IMPLIED WARRANTIES AND REPRESENTATIONS, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF ACCURACY OF DATA, AND NON-INFRINGEMENT. IF YOU ARE DISSATISFIED OR HARMED BY JOBMATES OR ANYTHING RELATED TO JOBMATES SERVICES, YOU MAY CLOSE YOUR JOBMATES ACCOUNT AND TERMINATE THIS AGREEMENT IN ACCORDANCE WITH THE TERMINATION CLAUSE AND SUCH TERMINATION SHALL BE YOUR SOLE AND EXCLUSIVE REMEDY. JOBMATES IS NOT RESPONSIBLE, AND MAKES NO REPRESENTATIONS OR WARRANTIES FOR THE DELIVERY OF ANY MESSAGE (SUCH AS EMAILS, POSTING OF ANSWERS OR TRANSMISSION OF ANY OTHER GENERATED CONTENT) SENT THROUGH JOBMATES TO ANYONE. IN ADDITION, WE NEITHER WARRANT NOR REPRESENT THAT YOUR USE OF THE SERVICES WILL NOT INFRINGE THE RIGHTS OF THIRD PARTIES. ANY MATERIAL, SERVICE, OR TECHNOLOGY DESCRIBED OR USED ON OUR MOBILE APPLICATIONS AND/OR WEBSITES AND/OR BY ANY OTHER MEDIUM MAY BE SUBJECT TO INTELLECTUAL PROPERTY RIGHTS OWNED BY THIRD PARTIES WHO HAVE LICENSED SUCH MATERIAL, SERVICE, OR TECHNOLOGY TO US. JOBMATES SHALL NOT BE OBLIGED TO VERIFY THE IDENTITY OF PERSONS SUBSCRIBING TO ITS SERVICES, NOR DOES SHALL IT OBLIGE TO MONITOR THE USE OF ITS SERVICES BY OTHER USERS OF THE COMMUNITY. THEREFORE, JOBMATES DISCLAIMS ALL LIABILITY FOR IDENTITY THEFT OR ANY OTHER MISUSE OF YOUR IDENTITY OR INFORMATION BY OTHERS. JOBMATES DOES NOT GUARANTEE THAT THE SERVICES IT PROVIDES WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS IN FUNCTIONING. IN PARTICULAR, THE OPERATION OF THE SERVICES MAY BE INTERRUPTED DUE TO MAINTENANCE, UPDATES, OR SYSTEM OR NETWORK FAILURES. JOBMATES DISCLAIMS ALL LIABILITY FOR DAMAGES CAUSED BY ANY SEARCH INTERRUPTION OR ERRORS IN FUNCTIONING. FURTHERMORE, JOBMATES DISCLAIMS ALL LIABILITY FOR ANY MALFUNCTIONING, IMPOSSIBILITY OF ACCESS, OR POOR USE CONDITIONS OF THE JOBMATES SITES OR APPLICATIONS DUE TO INAPPROPRIATE EQUIPMENT, DISTURBANCE RELATED TO INTERNET SERVICE PROVIDERS, TO THE SATURATION OF THE INTERNET NETWORK AND FOR ANY OTHER REASON.
